1. Acceptance of these terms

These Terms of Use (“Terms”) govern your access to and use of the Ibex Insights website, the free public data tool, and related content and services (together, the “Service”) operated by Ibex Insights (“Ibex Insights,” “we,” “us,” or “our”). By accessing or using the Service you agree to be bound by these Terms and by our Privacy Policy and Cookie Policy. If you do not agree, please do not use the Service.

2. The Service

Ibex Insights provides higher-education data, analytics, and digital-strategy resources, including a free public data tool that presents aggregate, institution-level statistics. We may add, change, suspend, or discontinue any part of the Service at any time. While the public data tool is offered free of charge, we reserve the right to introduce separate paid products or services governed by their own terms.

3. Public data & no warranty of accuracy

The data tool compiles figures from public sources such as the U.S. Department of Education College Scorecard, the Integrated Postsecondary Education Data System (IPEDS), Federal Student Aid, the U.S. Census Bureau, the Bureau of Labor Statistics, and WICHE. These sources are provided “as is” and may contain errors, gaps, lags, or revisions. We derive, benchmark, and present these figures in good faith but do not warrant that any metric, percentile, peer comparison, projection, or score is complete, current, or accurate. Nothing in the Service is financial, legal, enrollment, investment, or professional advice, and you should independently verify any figure before relying on it.

4. Acceptable use

You agree not to:

• Use the Service for any unlawful purpose or in violation of these Terms;
• Scrape, harvest, or bulk-download the Service in a manner that imposes an unreasonable load on our infrastructure, or circumvent any technical limits;
• Misrepresent the source of the data or present it in a false or misleading way;
• Introduce malware, attempt to gain unauthorized access to our systems, or interfere with the Service’s operation or security;
• Use the Service to infringe the rights of others or to harass any person.

5. Intellectual property

The Service’s design, text, graphics, logos, the “Ibex Insights” name, and the original compilation, derivation, and presentation of data are owned by Ibex Insights or its licensors and are protected by intellectual-property laws. The underlying public-source data is generally in the public domain or made available under its providers’ own licenses. You may view and reference our published figures for your own internal, non-commercial evaluation with attribution to “Ibex Insights” and the original data source; any other reproduction, redistribution, or commercial use requires our prior written permission.

6. Third-party content & links

The Service may link to or display content from third parties. We do not control and are not responsible for third-party websites, services, or content, and a link does not imply our endorsement. Your use of any third-party service is governed by that party’s terms.

7. Disclaimers

THE SERVICE AND ALL DATA ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

8. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IBEX INSIGHTS AND ITS PRINCIPALS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SERVICE OR ANY RELIANCE ON THE DATA, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. WHERE LIABILITY CANNOT BE EXCLUDED, IT IS LIMITED TO THE GREATEST EXTENT PERMITTED BY APPLICABLE LAW.

9. Indemnification

You agree to indemnify and hold harmless Ibex Insights from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of your use of the Service or your breach of these Terms.

10. Governing law

These Terms are governed by the laws of the United States and the State in which Ibex Insights is established, without regard to conflict-of-laws principles. Any dispute will be subject to the exclusive jurisdiction of the courts located there, unless mandatory law in your country of residence provides otherwise.

11. Changes to these terms

We may update these Terms from time to time. The “Last updated” date above reflects the latest version, and your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
